The American Way

Daniel Schuler has filed a lawsuit against the State of New York. Who is Daniel Schuler? On July 26, 2009 his wife Diane Schuler, killed herself and seven others in a wrong-way crash on the Taconic State Parkway. He’s also suing his brother-in-law, whose three daughters were victims.

Mr. Schuler claims “the highway was poorly designed and lacked proper signs.” I can agree with that statement, when you consider that the Taconic was originally a road through a park (thus the designation Parkway) and now is a major highway through New York State, it could be considered poorly designed. As for the signs, it was reported that Ms. Schuler drove past a “Do Not Enter” sign when she entered the Taconic driving the wrong way.

As she drove down the road, other drivers honked their horns at her. I have been on the Taconic and know there are few places to pull over, put bluntly, I hate driving on the Taconic, some parts of it are downright scary to me. However, poor design and inadequate signage do not give a pass to a woman who was driving drunk and high, especially with children in the car.

Her husband disputes such claims, saying that if she had a stroke she might have mistaken Vodka for water. His son says, “Mommy’s head hurt.” I think that if I had drunk 10 shots of Vodka and smoking weed, my head would hurt too. But that’s just me.

He also states that since his brother-in-law owned the minivan he is “vicariously liable.” I think Daniel Schuler is “vicariously liable” for not noticing a problem with his wife. I firmly believe that a person does not suddenly down a bottle of Vodka and smoke marijuana because they are having a ‘bad day’. If she had a mental problem, or depression that has been developing for a while that is something that someone should have noticed. Maybe Mr. Schuler is feeling guilty and wants to push the guilt off on someone else. Maybe he is just a greedy SOB that wants to make money off the death of innocent people.

Whatever his reasons, when his wife got behind the wheel of that minivan drunk and high, she was committing what ended up being premeditated murder. Since she’s dead she can’t be held liable for her actions. Pushing the guilt off on other people only serves to make other people who are already suffering, suffer more.

Diane Schuler, her 2-year-old daughter, Erin, and her three nieces died in the July 26, 2009, crash, as did the three occupants of the SUV: Michael Bastardi Sr., Guy Bastardi and Daniel Longo of Yonkers.

Bad words are forming in my head

Dear Asurion,

Listen you ignorant spawn of the Devil, for the third time I did not receive my replacement device on May 26, 2011. I received the wrong device which I returned and you told me you received. I received the correct device on June 15, 2011. Stop threatening to charge me a restocking fee you ignorant Devil-spawn.

apparently my cell phone saga is done. I say apparently because when I was reading the list of Customer complaints for Asurion, one of them was that the customer was told the phone had water damage when it didn’t. I still have to send the broken phone back so I don’t get charged a restocking fee. That is why my ordeal is not quite over yet.

When I got the e-mail from American Express stating my payment was due, I went on the website and filed a disputed charge claim. I told them, wrong merchandise shipped, I called the company, got no response and have returned the merchandise with a letter stating the problem and still had no response.

When I received the e-mail I posted in my last post, I called the number in the e-mail. I spoke to customer service, then I got transferred to technical support (Jay), Jay then said I had to speak to a supervisor to needed to know what address to send the replacement phone to. The supervisor told me the phone was being sent out.

Here is what frustrates me. When I returned the wrong phone I included a letter, in that letter was the specifics of why it was the wrong phone and what I wanted Asurion to do, send me the correct phone. I also put my address, my cell phone number, my work number and my e-mail address. I still had to call them to get them to do anything. And why did he have to get my address and phone number and e-mail address when they already had them! They had all that information from the original claim number, which was also on the letter I sent them and on every e-mail they sent me.

So I got my phone on Wednesday, June 15, 4 weeks and 7 phone calls after I filed my claim. When I opened the box, it was a brand new iPhone, it the box, shrink wrapped, just the phone I got from the store. When I went on line with American Express, there was a notation that they had contacted the company. That is what probably lit a fire under their soulless devil-spawn asses. American Express, a company that knows what customer service is, and shakes a might big stick.

This was their mistake. They sent the wrong phone and I’m the one having to run around like a crazed person!!

How sad is it

How sad is it that I was deliriously happy to see gas at less then $4 a gallon? Especially since it was $3.99 per gallon.

Imagine my disappointment to find out it was a lie. It was only that price if you were paying cash, which I wasn’t because I didn’t have any.

How absurd is it that it costs $40 to fill the tank of a mini-car?

The mystery continues

The mystery of my spotty internet connection that is. I took my laptop to the boy to look at and he did. He found no problems with the connection and while I was upstairs neither did I, until I came back downstairs to the room where I usually keep it and do my blogging.

It’s the room where my TV is, I like to watch TV and blog, I don’t know why, it’s like I a minor distraction in order to string my words into coherent thoughts.

The basement where my apartment is looks like this: when you come down the stairs the bathroom is to the left from the stairs, the next door over to the right from the bathroom is to my friend’s husband/son’s workroom, it has computers and tools in it, next to that is my TV/sewing room, my TV, sewing machine, laptop, printer and other miscellanea are in there. The last room, next to the back door is my bedroom. There is gray cabinet and the washing machine.

Here is the weird thing that is happening, when I go in the room where I normally go online, where I’ve been going online for a long time and never had a problem until the recent hacker business. Now I am having problems going online there. So I went in my bedroom. I was thinking since there is a window in my bedroom that would help. It didn’t.

So I went in the other room in the basement, the only room that’s not “mine”, and there it works. I went upstairs to tell the boy and he agreed with me that it is weird.

For now and into the foreseeable future, I will be typing my blogs in Word and pasting to WordPress. Such a pain in the butt.

Pet peeves

We all have them, well most of us do. One of mine is people who don’t know what “I don’t know” means.

People come up to me in Grand Central and ask for directions. First of all, I’m usually walking around all dazed and confused, bumping into the walls and such, why anyone would ask me directions is beyond me.

Second, there is a freaking huge map about six steps away from us, go look at the map. But no, they have to ask me, “How do I get to Murray Hill?” “what subway goes up Lexington?” I know how to get to my office, I know how to get to my Dr and the dentist. Anything else I don’t know. When I say “I don’t know.” They rephrase the question. I still don’t know the answer but now that they have pissed me off, I lie. “Yes the 6 train will get you there.” The alternative is to snarl at them, “Look at the [#%^*] map.” So take the 6 train and have a nice life, where ever it takes you.

On May 4th the 16 anti-choice Democrats joined every House Republican present in passing H.R. 3, the No Taxpayer Funding For Abortion Act. A chief weapon in the House GOP’s “comprehensive assault” on women this bill proposes some of the most radical and draconian restrictions on women’s rights. Read the complete article here.

The Hyde Amendment prevents some federally funded health-care programs from covering abortions, allowing exemptions in cases of rape and incest, and when the life of the woman is threatened. The new bill changes the wording from rape to “forcible rape”. Opponents of the bill say the wording is to exclude woman who say no but do not physically fight off the perpetrator, women who are drugged or verbally threatened and raped, and minors impregnated by adults. Supporters say that is not true.

According to New York State Law under Sex offenses; lack of consent, the law reads:

1. Whether or not specifically stated, it is an element of every offense defined in this article, except the offense of consensual sodomy, that the sexual act was committed without consent of the victim.
2. Lack of consent results from:
(a) Forcible compulsion; or
(b) Incapacity to consent; or

The law also defines forcible compulsion:

“Forcible compulsion” means to compel by either:
a. use of physical force; or
b. a threat, express or implied, which places a person in fear of immediate death or physical injury to himself, herself or another person, or in fear that he, she or another person will immediately be kidnapped.

Let me explain, if a man comes up to me and points a gun at my head, or to my friend/parent/child and says they are going to shoot me or them unless I have sex with them, and I comply, I am a victim of forcible rape. If it turns out the gun was not loaded, I am still a victim of forcible rape, because I was in fear of immediate death or physical injury to myself or another person. I think most reasonable persons would agree with that statement. Oh wait, this is the GOP not reasonable people, a bunch of fucking morons.

The law of the State of New York seems to support the supporters of this bill, note the following:

Rape in the third degree.
A person is guilty of rape in the third degree when:
1. He or she engages in sexual intercourse with another person who is incapable of consent by reason of some factor other than being less than seventeen years old;
2. Being twenty-one years old or more, he or she engages in sexual intercourse with another person less than seventeen years old; or
3. He or she engages in sexual intercourse with another person without such person`s consent where such lack of consent is by reason of some factor other than incapacity to consent.
Rape in the third degree is a class E felony.

“Forcible compulsion” is included in lack of consent and rape in the third degree is a felony, a crime that will get you time at least a year in state prison and as long as four years (which is a pitiful amount of time but that’s not today’s discussion).

The real problem, as I see it, with this bill and the ‘forcible’ rape wording is the matter of ‘incapacity to consent’

3. A person is deemed incapable of consent when he or she is:
(a) less than seventeen years old; or
(b) mentally disabled; “Mentally disabled” means that a person suffers from a mental disease or defect which renders him or her incapable of appraising the nature of his or her conduct. or
(c) mentally incapacitated; “Mentally incapacitated” means that a person is rendered temporarily incapable of appraising or controlling his conduct owing to the influence of a narcotic or intoxicating substance administered to him without his consent, or to any other act committed upon him without his consent. or
(d) physically helpless; “Physically helpless” means that a person is unconscious or for any other reason is physically unable to communicate unwillingness to an act. or

There is no reason to think that a woman falling into any of the above situations wasn’t really raped, yet it appears the GOP feels this way. The result is a woman who has already been traumatized, perhaps feeling guilty because she DIDN’T fight back or was drugged or drank too much, now has to deal with the GOP violating her and taking away her rights.

This is my main problem with this, because this isn’t just about paying for abortions for rape and incest victims, it the GOP thinking they are the shit and can just take away our rights, preventing women from buying health coverage that covers reproductive health care, including family planning. They want to cut funding to Planned Parenthood. Which is something I have never understood, they don’t want to pay for abortions, they also don’t want to pay for birth control! And while I don’t support Planned Parenthood, I am in full support of women’s rights. I am a single woman, I have to rely on my income to support myself and this is definitely a concern.

While although I’m not advocating we descend on Washington with armored tanks, (although it is a tempting idea just to see them running away after shitting their pants) this is definitely something to keep our eye on.

Protests at Military Funerals Are Protected Speech, Justices Rule

The Supreme Court ruled on Wednesday that protests and picketing at military funerals are protected by the First Amendment’s free-speech guarantee, taking precedence over the mourners’ right to privacy.

The court decided 8-1 to uphold a lower court decision in favor of members of the Westboro Baptist Church of Topeka, Kan., who frequently stage protests at private military funerals to promote the church’s claim that God is angry at America for its tolerance of homosexuality, with signs bearing messages like “Thank God for Dead Soldiers,” “You’re Going to Hell” and “God Hates the USA.”

The ruling was a defeat for Albert Snyder, the father of a Marine killed in Iraq in 2006, whose funeral at a Catholic church in Westminster, Md., was picketed by the Westboro group.

These people claim to be Christian, there is nothing Christ like about their conduct. Christ raised the dead, he healed sick people, he RELIEVED suffering. He wept when he saw others grieving their dead loved ones. He healed the servant of a Roman Military Officer. They are more like the Pharisees of whom Jesus said, “You are from your father the Devil.” The Devil delights in death and suffering.

They are also saying that God, who created the world, who made the heavens with all the stars. Millions of powerful angels, one of whom was able to kill 185,000 Assyrians in one night, who rained fire and sulfur on Sodom and Gomorrah needs other country’s soldiers to express his displeasure. Not true.

The most dangerous job

There have been studies done about this and articles written. Right now I can’t remember what any of them said, but in my opinion the most dangerous job in the U.S. is Border Patrol Agent.

According to this article in the Arizona Daily Star, Records show agents fired beanbags in fatal border gunfight. Border agents are instructed to use non-lethal force when confronting illegal aliens with guns.

Border Patrol officials declined to answer questions about protocol for use of force, citing the ongoing investigation.

But Terry’s brother, Kent Terry, said the other agents who were there that night told him that they were instructed to use the non-lethal beanbags first. It’s a policy that doesn’t make sense to Kent Terry.

It doesn’t make sense to me either, if an NYPD officer sees a person pointing a gun at anyone, and the person won’t put the gun down, they are going to get shot. Usually about a billion times (I don’t have a problem with that, if you’re that stupid, kind of like kicking a police dog, if you’re that stupid, you deserve to have your leg bitten off). The article goes on to mention that the bullet removed from the agent is the kind used in AK-47’s. So you have the bad guys, with AK-47, and the good guys are shooting bean bags at them. To me, being a Border Patrol Agent should be listed as THE MOST DANGEROUS JOB.
